    ARTICLE XIV – AMENDMENTS

     

    ARTICLE I – NAME 

    The name of this organization shall be the Bellefonte Area School District Performing Arts Boosters, Inc., hereinafter, referred to as the Performing Arts Boosters.

     

    ARTICLE II – FOCUS AND FUNCTION 

    Our focus is to support all facets of the performing arts program of the Bellefonte Area School District (this includes the band, choir, orchestra and drama/theatre programs); lend financial support to supplement equipment, supplies and program opportunities to ensure that every year, students in every performing art discipline have a unique educational experience; and support advocacy activities for the promotion of the performing arts program in the Bellefonte Area School District.

    Our function is to provide a board approved adult volunteer base to serve as chaperones at football games, competitions and performing arts trips; provide support to performing arts staff; provide staff to operate food stands at home football games; and coordinate and execute fundraisers to meet our financial needs.

     

    ARTICLE III – FINE ARTS DEPT. CHAIR 

    Section 1 – Fine Arts Dept. Chair (as assigned by the administration) shall be the official liaison between the Performing Arts Boosters and Bellefonte Area School District.

    Section 2 – Fine Arts Dept. Chair will serve as a non-voting resource to facilitate the needs of the Executive Committee and/or the overall organization.

     

    ARTICLE IV – MEMBERSHIP 

    Section 1 – The membership of the Performing Arts Boosters shall be open to anyone wishing to support the performing arts program of the Bellefonte Area School District

    Section 2 – Membership is open to any supporter of the District's performing arts program without any membership fees and grants the member voting privileges.

    Section 3 - Attendance at a Performing Arts Booster meeting constitutes membership. 

    Section 4 – Membership shall be open, without discrimination, to anyone who believes in and supports the purpose of the organization and who agrees to abide by the By Laws of the organization.

      

    ARTICLE V – OFFICERS

    Section 1 – The officers of this organization shall be a PRESIDENT, VICE PRESIDENT, SECRETARY, and TREASURER. All officers must be in compliance with Bellefonte Area School District’s volunteer policy which shall include criminal and child abuse clearances.

    Section 2 – Any Booster shall be eligible to run for and serve as an officer and/or chairperson of any committee.

    Section 3 – Terms of office for all officers shall be two years. The PRESIDENT and SECRETARY shall be elected on even numbered years, and the VICE PRESIDENT and TREASURER shall be elected on the odd numbered years.

    Section 4 – In the event that an officer cannot complete his/her term for any reason, a replacement for that term will be appointed by majority vote of the remaining members of the Executive Committee.

     

    ARTICLE VI – DUTIES OF OFFICERS

    Section 1 – The PRESIDENT shall preside at all meetings of the organization, appoint all committees, and shall be an ex-officio member of all committees, except the nomination committee.

    Section 2 – The VICE PRESIDENT shall assume all the duties of the President in his/her absence. He/she shall serve as the chairperson of the Membership, Nomination and By-laws Review Committees and assume other duties as are deemed necessary.

    Section 3 – The SECRETARY shall keep the records and minutes of all meetings, attend to the correspondence, and perform other duties as deemed necessary.

    Section 4 – The TREASURER shall receive all funds due the organization, deposit same, pay all bills as determined by the membership, maintain financial records, prepare cash boxes for all Performing Arts Booster events including distribution and collection, process PA sales tax exemption and Federal non-profit status form, and submit the books to the Financial Review Committee.

     

    ARTICLE VII – THE EXECUTIVE COMMITTEE

    Section 1 – The Executive Committee shall be composed of the elected officers of the organization, the District Representative(s), and the members-at-large appointed by the PRESIDENT to represent each constituency supported by the boosters. At any given time, there will be no more than five members-at-large. All members of this committee will be voting members with the exception of the District Representative(s).

    Section 2 – The Executive Committee shall have the emergency power to act for the membership between meetings of the organization.

    Section 3 – The Executive Committee shall meet at a minimum, once monthly, in addition to the regular monthly meeting of the Performing Arts Boosters.

    Section 4 – In the event the Executive Committee finds reason for dismissal of a fellow officer, (i.e., relating to matters detrimental to the function of the booster organization) the matter will be brought to the attention of the Fine Arts Dept. Chair as per school district policy.

    Section 5 – It will be at the discretion of the Executive Committee to invite any appropriate personnel for discussion relevant to issues at hand.

    Section 6 – It will be at the discretion of the PRESIDENT, with the Executive Committee’s approval, to appoint an additional member-at-large for the purpose of training for future offices, not to exceed 5 (see Section 1).

     

    ARTICLE VIII – MEETINGS

    Section 1 – The regular meeting of this organization shall be held monthly, except when changed by a vote of the Executive Committee.

    Section 2 – Special meetings may be called by the PRESIDENT. Notice of the date, time, place and business to be transacted shall be given by the SECRETARY or designee to the members at least five (5) days in advance. Only that business for which notice has been given shall be transacted.

    Section 3 – A Quorum shall consist of those members present.

    Section 4 – Attendees must sign in.

     

    ARTICLE IX - COMMITTEES

    Section 1 – Standing committees shall consist of: Membership, Nomination, By-laws Review, and such other committees as the PRESIDENT shall deem necessary.

    1a. The Membership and Nomination Committee shall consist of the VICE PRESIDENT (chairperson) and at least one member from the general membership. The Membership/Nomination Committee shall present a slate of officers to the membership at the regular April meeting. Nominees shall be chosen from a roster of active members and presented to the Executive Committee for certification prior to the April meeting.

    1b. The By-laws Review Committee will meet annually between the April and May meetings to review the By-laws and present any recommended changes at the June meeting for approval.  

    Section 2 – A Financial Review Committee shall consist of three (3) members, other than officers, who shall review the books of the organization between the regular meetings from July 1st to September 30th. Findings will be presented at the October Performing Arts Booster meeting.  

    Section 3 – All committees and meetings shall have documentation of the date(s) and those in attendance for record purposes.

     

    ARTICLE X – DUES

    Dues may be reinstated by the Membership/Nomination Committee, subject to the approval by a majority vote of the membership present at the next regularly scheduled Performing Arts Booster meeting.

     

    ARTICLE XI – ELECTIONS

    Section 1 – The Membership/Nomination Committee shall present a slate of officers at the regular April meeting of each year. Nominations may be made from the floor after the report of the Membership/Nomination Committee.

    Section 2 – Officers are to be elected at the regular May meeting by paper ballot. They shall take office at the first regular Performing Arts Booster meeting on or after the July meeting.

    Section 3 – A majority vote of the members present shall constitute an election.

     

    ARTICLE XII – FINANCES

    Section 1 – The TREASURER, with approval of the Executive Committee, shall prepare and submit for approval a business outline and budget for the following school year as per Bellefonte Area School District policy.  This budget shall be voted and approved at the June meeting or the last meeting for that school year.

    Section 2 – The PRESIDENT, VICE PRESIDENT, TREASURER, and SECRETARY of the Performing Arts Boosters shall be bonded.

    Section 3 – The TREASURER shall process all funds due the Performing Arts Boosters, issue appropriate receipts, be solely responsible for deposit of funds, and shall pay all bills upon authorization of the fine arts boosters and maintain all financial records.

    3a. The TREASURER will provide Bellefonte Area School District all required documents as per booster policy.

    3b. The TREASURER, with approval of the Executive Committee, has the authority to delegate financial responsibilities to include obtaining, managing and reconciling monies to designated Performing Arts Boosters members for fundraising events as needed.  

    3c. The TREASURER is authorized to apply a $35 fee to any non-sufficient funds check written to the organization.

    3d. The TREASURER shall give a complete financial report at each regular Performing Arts Booster meeting.

    Section 4 - Two bonded officer signatures are required on each check.

    Section 5 – A majority of the Executive Committee can authorize emergency expenditures up to three hundred dollars ($300).

     

    ARTICLE XIII – PARLIAMENTARY AUTHORITY

    The rules contained in Robert’s Rules of Order Newly Revised shall govern this organization in all cases in which they do not conflict with the rules of this organization or the policy of the Bellefonte Area School District.

     

    ARTICLE XIV – AMENDMENTS

    These By-laws may be amended by a 2/3 vote of those present at any regular meeting. The amendments must have been presented at the preceding regular meeting of the organization.

     

    Fine Arts Booster By-Laws approved on October 2, 2012 Fine Arts General Membership Meeting.

    Revised at September 2, 2014 Booster Meeting. Bylaws were then voted to approve with no changes or additions. Motion passed. 

    Revised at November 4, 2014 Booster Meeting.  Name change and appropriate bylaws noting the name were changed.  Motion passed.

    Revised at September 6th, 2016 Booster Meeting.  Dates Changed on bylaw review.  Motion passed.

    Revised and voted to approve with changes at May 28, 2019 Booster Meeting.
