EXCLUSIVE CONTRACTING BY DISTRICT |
|
1. Authority |
The Board
recognizes that in certain instances and with certain limitations it may
be in the best interest of the district to enter into an exclusive
contract for the provision of goods and/or services for a fixed period of
time. |
|
2. Definition |
An
exclusive contract is one which obligates the district to limit
its purchase of particular goods or services to one vendor for a specific
duration, in exchange for certain consideration from that vendor. |

3. Guidelines |
The
administration shall be guided by the following principles and any
exclusive contracts shall conform to the following guidelines: |

1.
The integrity, identity and/or reputation of the Bellefonte Area
School District shall not be sacrificed or diminished by any exclusive
contract arrangement. |
|
|
2.
No vendor shall be permitted to utilize the name or any identifying
marks of the Bellefonte Area School District without specific Board
approval. |
|
|
3.
Any exclusive contract arrangement shall not permit unlimited
advertisement by vendor on school premises or the district Web site.
Vendor's proposal shall disclose to district any proposed advertising,
which shall be subject to district review and approval. |

4.
Any solicitation by the vendor of students, faculty or members of the
community on school premises or the district Web site shall be subject to
district review and approval. |
|
|
5.
Exclusive contracts shall be entered into only when the financial or
other benefits to the district outweighs any obligations which the
contract might impose upon the district. |
|
|
6.
The duration of an exclusive contract shall generally be no longer
than five (5) years, subject to exceptions in the best interests of the
district. |
|
|
7.
Exclusive contracts shall be entered into only after request for
proposals and/or competitive negotiation by the administration and
compliance with all relevant laws and regulations pertaining to the
district. |

8.
Exclusive contracts shall contain provisions to protect the
educational environment and avoid disruption by the vendor to the
operations of the district. |
|
|
9.
Revenues from exclusive contracts shall be recognized and accounted
for in the General Fund, in accordance with Pennsylvania Department of
Education guidelines. |
